2 Postanowienia ogólne

Jaktorowska 15A, 96-300 Żyrardów, NIP 8381845401 wpisana do rejestru przedsiębiorstw prowadzonego przez Sąd Rejonowy dla Łodzi Śródmieścia w Łodzi, XX Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0000429499 (zwana dalej „Administratorem”).

3. Użytkownikiem jest każda osoba fizyczna korzystająca z usług świadczonych za pośrednictwem Gry.

4. Użytkownik przyjmuje do wiadomości, że udostępnienie przez niego danych osobowych jest dobrowolne. Udostępnianie Administratorowi danych osobowych przez Użytkownika nastąpi po

zaakceptowaniu Polityki Prywatności podczas rejestracji w Grze.

5. Dane osobowe, udostępniane przez Użytkownika, mogą być wykorzystywane przez Administratora w celach marketingu bezpośredniego i usług Administratora, poprawienia funkcjonalności Gry, poprawienia szybkości jej działania, dopasowania treści oferty do oczekiwań i preferencji Użytkownika ustalonych na podstawie jego zachowania online podczas przeglądania stron internetowych.

6. Niniejszym Użytkownik akceptuje zasady zawarte w Polityce Prywatności i w Regulaminie.

3 W jakich celach i na jakiej podstawie wykorzystujemy dane Użytkownika?

W ramach korzystania przez Użytkownika z Gry dane osobowe są przetwarzane w następujących celach:

1. marketingu bezpośredniego produktów i usług Administratora – podstawą prawną przetwarzania danych jest niezbędność przetwarzania do realizacji prawnie uzasadnionego interesu Administratora (art. 6 ust. 1 lit. f RODO); uzasadnionym interesem Administratora jest możliwość przedstawienia Użytkownikom informacji o usługach Administratora, przedstawienia przez niego ofert oraz zwiększenie sprzedaży usług Administratora;

2.poprawienia funkcjonalności Gry, poprawienia szybkości jej działania, dopasowania treści oferty do Użytkownika, jego oczekiwań i preferencji ustalonych na podstawie zachowania online Użytkownika podczas przeglądania stron internetowych; oferty zamieszczane są na naszej stronie internetowej lub stronach internetowych innych podmiotów; pliki cookie mogą być zamieszczane przez podmioty, z którymi współpracujemy; pliki cookie mogą zbierać dane o zachowaniu Użytkownika w sieci czy adresie IP; utrzymania sesji użytkownika Gry (po zalogowaniu)

3. ustalenia, dochodzenia lub obrony przed roszczeniami – podstawą prawną przetwarzania danych jest niezbędność przetwarzania do realizacji prawnie uzasadnionego interesu administratora (art. 6 ust. 1 lit. f RODO); uzasadnionym interesem Administratora jest ochrona przed roszczeniami związanymi z korzystaniem z Gry.

Dane osobowe Użytkownika są przetwarzane w celu dostarczenia wiadomości SMS i powiadomienia PUSH.  Podstawą przetwarzania danych osobowych Użytkownika jest niezbędność przetwarzania do korzystania z Gry i jej funkcjonalności (art. 6 ust. 1 lit. b RODO) oraz realizacja naszego prawnie uzasadnionego interesu, którym jest możliwość przedstawienia informacji o naszych usługach i produktach, przedstawienia przez nas ofert oraz zwiększenie sprzedaży naszych usług i produktów (art. 6 ust. 1 lit. f RODO).

4 Zbieranie danych osobowych

1. W trakcie rejestracji w Grze i korzystania z Gry, Użytkownik zgadza się na podanie danych osobowych.

2. Dane osobowe Użytkownika zbierane w sposób określony w ust. 1 powyżej obejmują m.in.:

nazwisko, imię, adres e-mail, numer telefonu, data urodzenia.

Dane profilu to dane dotyczące Użytkownika. Dane profilu obejmują przykładowo:

– Imię i nazwisko użytkownika

– Dane kontaktowe użytkownika

– Numer telefonu

– Adres e-mail

– Data urodzenia

5 Przetwarzanie danych osobowych

1. Zebrane dane osobowe Użytkownika będą wykorzystywane przez Administratora celem dostarczenia usług oferowanych przez Grę tj. zbieranie monet i wymiana ich na ulepszenia plansz i ciężarówek.

2. Celem przetwarzania danych jest przede wszystkim umożliwienie Użytkownikom zbierania punktów, które będą wymieniane na ulepszenia gry.

6 Prawa i obowiązki Administratora

1. Administrator zobowiązuje się przetwarzać dane osobowe Użytkownika z zachowaniem wymogów RODO oraz ustawy z dnia 18 lipca 2002 roku o świadczeniu usług drogą elektroniczną.

2. Administrator gwarantuje zapewnienie odpowiednich środków technicznych i organizacyjnych zapewniających bezpieczeństwo przetwarzanych danych osobowych, w szczególności uniemożliwiających dostęp do nich nieuprawnionym osobom trzecim, lub ich przetwarzania z naruszeniem przepisów powszechnie obowiązującego prawa, zapobiegających utracie danych osobowych, ich uszkodzeniu lub zniszczeniu.

3. Dane osobowe Użytkownika będą przechowywane tak długo, jak będzie to konieczne do realizacji przez Administratora usług świadczonych za pośrednictwem Gry.

4. Administrator ma prawo udostępniania danych osobowych Użytkownika: spółkom zależnym; stronom trzecim w przypadku sprzedaży im całości lub części swoich udziałów, lub w przypadku fuzji Administratora ze strona trzecią, lub nabycia udziałów w Spółce Administratora przez stronę trzecią; innym podmiotom trzecim, które zaakceptowały Politykę Prywatności, o ile Administrator zawarł z nim umowę konieczną do realizacji przez Administratora usług świadczonych za pośrednictwem Gry; właściwym organom, które zgłoszą konieczność udostępnienia danych osobowych w oparciu o odpowiednie podstawy powszechnie obowiązującego prawa.

7 Prawa i obowiązki Użytkownika

1. Użytkownik ma prawo dostępu do swoich danych osobowych za pośrednictwem Gry.

2. Użytkownik może w każdej chwili dokonać modyfikacji, zmiany, uzupełnienia lub usunięcia udostępnionych danych osobowych, za pośrednictwem narządzi dostępnych w Grze.

3. W przypadku trwałego usunięcia przez Użytkownika danych osobowych, koniecznych do realizacji przez Administratora usług świadczonych za pośrednictwem Gry, Użytkownik utraci możliwość korzystania z tych usług.

4. Administrator zastrzega sobie prawo wprowadzenia zmian w Polityce Prywatności, o czym poinformuje Użytkownika za pośrednictwem Gry. Jeżeli Użytkownik nie wyrazi zgody na wprowadzone zmiany, zobowiązany jest trwale usunąć Grę ze swojego urządzenia mobilnego.

2 General Provisions

1. This Privacy Policy (hereinafter referred to as the “Privacy Policy”) governs the manner in which EMKA S.A. collects, processes and stores personal data necessary for the execution of the services provided by the mobile game Garbage Truck City Tycoon (hereinafter referred to as the “Game”).

3. A User is any natural person using the services provided through the Game.

The personal data provided by the User may be used by the Administrator for the purposes of direct marketing and services of the Administrator, improving the functionality of the Game, improving the speed of its operation, matching the content of the offer to the User’s expectations and preferences determined on the basis of the User’s online browsing behavior.

6. The User hereby accepts the rules contained in the Privacy Policy and the Terms and Conditions.

6 Rights and obligations of the Administrator

1. The Administrator undertakes to process the User’s personal data in accordance with the requirements of RODO and the Act of 18 July 2002 on the provision of electronic services.

2. The Administrator guarantees to provide appropriate technical and organizational measures to ensure the security of the processed personal data, in particular to prevent access to them by unauthorized third parties, or their processing in violation of generally applicable laws, preventing the loss of personal data, their damage or destruction.

3. The User’s personal data will be stored for as long as it is necessary for the Administrator to perform the services provided through the Game.

4. The Administrator shall have the right to share the User’s personal data with: subsidiary companies; third parties in the event of a sale to them of all or part of their shares, or in the event of a merger between the Administrator and a third party, or the acquisition of shares in the Administrator’s Company by a third party; other third parties who have accepted the Privacy Policy, provided that the Administrator has entered into an agreement with them that is necessary for the Administrator to perform the services provided through the Game; competent authorities who report the need to share personal data based on the relevant grounds of generally applicable law.

7 Rights and Obligations of the User

1.  The User has the right to access his/her personal data through the Game.

2. the User may, at any time, modify, change, supplement or delete the personal data provided, through the tools available in the Game.

3. In the event that the User permanently deletes personal data necessary for the Administrator to perform the services provided through the Game, the User will lose the ability to use these services.

4. The Administrator reserves the right to make changes to the Privacy Policy, of which it will inform the User through the Game. If the User does not agree to the changes, he/she is obliged to permanently delete the Game from his/her mobile device.
